Welcome to Align Marketing (“we,” “us,” or “our”). By accessing or using our services, including websites, applications, and communications services (“Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use our Services.

Note: Align Marketing is currently operated by Matthew Rogers, sole proprietor.

Our Services provide marketing and lead generation support for businesses, including but not limited to SMS communications, digital advertising, and related automation services.

  • Comply with all applicable laws, regulations, and industry rules, including TCPA and A2P SMS regulations.
  • Obtain any necessary consent before sending messages through our Services.
  • Not use the Services for unlawful, fraudulent, or harmful purposes.

4. SMS & Communications

If you use our Services to send SMS or other messages:

  • You must only send messages to recipients who have consented to receive them.
  • You acknowledge that message delivery is not guaranteed and that standard message and data rates may apply to recipients.
  • You will comply with all applicable laws, including TCPA, CAN-SPAM, and other anti-spam regulations.

5. Content

You retain ownership of your content. By submitting content to our Services, you grant us a limited license to use it to provide the Services. You represent and warrant that you have all rights to the content you submit.

6. Prohibited Activities

You may not use our Services to:

  • Send unlawful, fraudulent, or harassing communications.
  • Interfere with our Services or servers.
  • Impersonate any person or entity or misrepresent your affiliation.

If applicable, you agree to pay all fees for the Services according to the pricing and billing terms communicated to you. All payments are non-refundable unless otherwise stated.

To the maximum extent permitted by law, Align Marketing will not be liable for any indirect, incidental, special, or consequential damages, including lost profits or data, arising from your use of the Services.

You agree to indemnify, defend, and hold harmless Align Marketing, its officers, employees, and affiliates from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict of law provisions.

We may update these Terms from time to time. The updated Terms will be effective upon posting. Your continued use of the Services constitutes acceptance of the changes.
